DMCA Policy

1. Our Commitment to Copyright Law

Toolza.in respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our website if such claims are properly reported to our designated copyright agent.

Toolza.in is a tool-based platform. We do not host, store, or distribute user-generated content. Our tools process files locally in users' browsers or temporarily on our servers, and all processed files are deleted automatically. We do not provide a content hosting service.

Because our tools are used to process files that users upload voluntarily, we may not always be aware of the content being processed. We rely on our users to ensure they have the legal right to use and process any files they upload to our tools.

2. DMCA Notice Requirements

For a DMCA notice to be valid under Section 512(c)(3) of the DMCA, it must contain all of the following elements:

• Physical or Electronic Signature: The notice must be signed by the copyright owner or a person authorized to act on their behalf.
• Identification of Copyrighted Work: A description of the copyrighted work that you claim has been infringed. If multiple works are covered, a representative list of such works may be provided.
• Identification of Infringing Material: A description of the specific location (URL) on Toolza.in of the material that you claim is infringing. This should be precise enough to allow us to locate the material.
• Contact Information: Your name, address, telephone number, and email address so we can respond to your notice.
• Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• Accuracy Statement: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Notices that do not contain all of these elements may not be processed. We strongly recommend consulting with a legal professional before filing a DMCA notice.

3. How to File a DMCA Complaint

To file a DMCA complaint with Toolza.in, follow these steps:

• Step 1: Prepare your written DMCA notice containing all the required information listed in Section 2 above.
• Step 2: Send your notice via email to dev.agxtechnologies@gmail.com with the subject line "DMCA Notice — Toolza.in".
• Step 3: We will acknowledge receipt of your notice within 2 business days.
• Step 4: We will review your notice and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
• Step 5: We will notify the affected user (if applicable) that their content has been removed and provide them with a copy of your DMCA notice.

Please note that we are not legal advisors and cannot provide legal guidance on copyright matters. If you are unsure whether your rights have been infringed, we recommend consulting with an attorney before proceeding.

4. Counter-Notification Process

If you believe that content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, you may send a counter-notification to our DMCA agent.

A valid counter-notification must contain the following information:

• Your physical or electronic signature.
• Identification of the content that has been removed or disabled and the location at which the content appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the judicial district where you reside (or, if outside the United States, the judicial district where Toolza.in may be found).

After receiving a valid counter-notification, we will forward a copy to the original complainant. The original complainant then has 10 business days to file a court action seeking a restraining order against the removal. If no such action is filed, we may restore the removed content.

5. Repeat Infringer Policy

Toolza.in maintains a strict policy regarding repeat infringers. In accordance with the DMCA and other applicable intellectual property laws, we will terminate the access privileges of users who are found to be repeat infringers.

Our repeat infringer policy works as follows:

• First Infringement: Upon receipt of a valid DMCA notice, we will remove or disable access to the infringing material and notify the user. The user will receive a written warning.
• Second Infringement: Upon receipt of a second valid DMCA notice for distinct content, the user's account or access may be suspended temporarily pending investigation.
• Third Infringement: Upon receipt of a third valid DMCA notice, the user's access to Toolza.in may be permanently terminated.

We reserve the right to deviate from this graduated approach in cases of particularly egregious infringement or when the circumstances warrant immediate action. Factors we consider include the nature of the copyrighted work, the volume of infringement, and whether the user acted in good faith.

As Toolza.in primarily provides tools rather than hosting content, our repeat infringer policy focuses on users who repeatedly use our tools to process infringing material and who are notified of such infringement.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney's fees. We take this provision seriously and will pursue claims of abuse of the DMCA process.
